CHAPTER 7

Trustee & estate property

A trustee administers the case and may sell nonexempt assets. Whether a particular property can be retained or sold requires a review of exemptions, liens, equity and the estate’s interest.

CHAPTER 13

Repayment plan & obligations

Chapter 13 uses a court-approved repayment plan. It may offer a way to address mortgage arrears, but ongoing obligations and plan requirements still matter. Ask counsel how a proposed sale would affect the case.

Discharge is not
the same as clear title.

A discharge releases personal liability for certain debts. Valid liens that were not avoided can remain. Have counsel and title professionals confirm the property’s status and any remaining sale requirements.

Does bankruptcy automatically mean I will lose my home?

No single outcome applies to every case. The chapter, exemptions, equity, liens and case facts matter. A bankruptcy attorney should evaluate your property before you rely on keeping or selling it.

Can I put the property on the market during a case?

Start with bankruptcy counsel. Ask who has authority over the property and what approvals are required for the broker’s engagement, listing, contract and closing. An owner’s signature or an accepted offer alone may not be enough.

Does a bankruptcy filing always stop foreclosure?

A filing generally stays many collection actions, but exceptions and limits apply. A creditor may seek relief from the stay. Ask counsel to verify the effect in your case, especially if a foreclosure sale is scheduled. Do not rely on this website or an inquiry to stop a sale.

Does a discharge remove the mortgage lien?

Not necessarily. Discharge concerns personal liability for specified debts. A valid lien that was not avoided can survive. Your attorney and title professionals should verify which liens and closing requirements remain.

How much of the sale proceeds can I keep?

This page cannot determine that. Ask counsel to review exemptions, liens, estate interests, costs and the applicable orders or plan. A market estimate is not an entitlement to proceeds.
